GENERAL TERMS AND CONDITIONS OF SEASONAL RENTAL
This rental is granted and accepted at the price, charges, and specific conditions indicated in the seasonal rental agreement, of which these general terms and conditions are an integral part.
We thank you for reading them carefully before signing the agreement.
LEGAL FRAMEWORK
The seasonal rental is concluded for temporary and leisure residence purposes only. The premises may not be used as a primary residence, and the tenant may not carry out any commercial, artisanal, or professional activity there.
Accordingly, the contract is governed by the provisions of the French Civil Code (Articles 1708 et seq.) as well as the terms set forth herein.
BOOKING
The booking is only confirmed upon receipt of the 30% deposit and the signed rental agreement including these general conditions.
The landlord reserves the right to rent to another party until the rental is confirmed.
Upon receipt of the required elements, the commitments of both parties become irrevocable.
BALANCE PAYMENT
The full rental amount and the additional cleaning fee must be paid:
- One month prior to arrival for bookings made more than one month in advance
- Or immediately for bookings made less than one month prior to arrival.
SECURITY DEPOSIT
A security deposit of €2000 (not debited) is required no later than 30 days before the rental start date.
The deposit may under no circumstances be considered as partial payment of the rent.
It may be provided via PayPal or by cheque, at the tenant’s discretion. It will not accrue interest.
If the deposit is insufficient to cover damage or missing items, the tenant agrees to cover the difference.
The deposit will be returned within a maximum of 10 days after the tenant’s departure, minus any deductions for damages, unpaid services, or lost keys.
If paid by cheque, the deposit cheque will be destroyed after the stay.
TOURIST TAX
The tourist tax, collected on behalf of the municipality, is included in the rental price.
CHECK-IN
The rental contract takes effect on the day of arrival from 4:00 PM and automatically ends on the day of departure at 10:00 AM.
The key box code will only be provided after full payment of the rental balance, cleaning fee, and security deposit.
Any claims or anomalies regarding the accommodation must be reported promptly during the stay. Otherwise, the premises and equipment are considered compliant and in good condition.
If urgent repairs within the landlord’s responsibility are required during the rental period, the landlord will do their best to carry them out. However, delays or unavailability of a contractor shall not engage the landlord’s liability.
HOLIDAY INSURANCE – RENTAL LIABILITY
The landlord disclaims any liability for theft or damage to the tenant’s personal belongings during the stay.
A safe is available in the master bedroom.
The tenant is responsible for any damage caused by themselves or their guests during the rental period. It is recommended that the tenant takes out liability insurance covering such risks.
The tenant must ensure their primary home insurance includes a holiday rental extension (“extension villégiature”). If not, the tenant must request this extension from their insurer or purchase dedicated holiday rental coverage.
Proof of insurance must be provided upon request.
ENERGY EXPENSES
Utility charges (water, electricity, and gas) are included in the rental price.
CLEANING, BED LINEN AND TOWELS
Bed linen and towels are included in the rental price.
The final cleaning is free of charge.
CHECK-OUT
The tenant must vacate the property by 10:00 AM on the day of departure and return the keys to the designated key box.
CANCELLATION POLICY
The deposit payment renders the contract irrevocable. In case of cancellation by the tenant, the full rent remains due, except in cases of force majeure or pandemic.
If the landlord cancels the booking, the deposit will be refunded. Further compensation may be requested unless the cancellation is due to force majeure.
JURISDICTION
For the enforcement of this agreement, both parties elect domicile at Domaine de Quincampoix, 91470 Les Molières, France, and agree that any dispute shall fall under the exclusive jurisdiction of the Judicial Court of Evry.
DISCLAIMER OF LIABILITY
The tenant acknowledges and accepts that insects and other animals may be present in the natural surroundings of the property, including but not limited to mosquitoes, wasps, spiders, and other native creatures.
While reasonable preventive measures are taken to minimize their presence, complete absence cannot be guaranteed.
The landlord shall not be held liable for any injury, illness, or discomfort resulting from bites, stings, or contact with animals or insects on the premises.
The tenant assumes full responsibility for taking necessary precautions, such as using insect repellents or any other appropriate protection.
This liability disclaimer applies to all occupants and guests present on the property during the rental period.
TENANT’S OBLIGATIONS
- The tenant agrees to comply with local regulations prohibiting barbecues and indoor fireplaces from May 1st to October 31st, and to take all necessary precautions regarding fire hazards, such as not discarding cigarette butts in the garden and avoiding any use of flammable objects (candles, incense, sparklers, etc.). A gas barbecue is available.
- Smoking is strictly prohibited inside all indoor areas. The tenant agrees to respect this rule and ensure it is respected by children and guests.
- The tenant must not dispose of items likely to block pipes (e.g., wipes, sanitary products) in sinks, bathtubs, or toilets, or they will be liable for the costs of repair.
- The tenant must ensure that the peace and quiet of the neighborhood (although distant) is not disturbed.
- They must personally occupy the premises and maintain them in a responsible and orderly manner. The tenant agrees to comply with all instructions listed in the house manual.
- The tenant may not sublet or transfer their rental agreement under any circumstances.
- The number of occupants must never exceed fifteen people.
- Pets are not allowed.
LANDLORD’S OBLIGATIONS
The landlord agrees to make the house available in a condition matching its description and to ensure all equipment is in proper working order.
